These Terms of Service (hereinafter "Terms") govern the relationship between piqe (hereinafter "the Company") and its users regarding the use of the piqe platform and related services. These Terms are established in accordance with the Act on the Regulation of Terms and Conditions, the Act on Promotion of Information and Communications Network Utilization and Information Protection, and the Act on Consumer Protection in Electronic Commerce.

Article 1. Purpose

These Terms set forth the rights, obligations, and responsibilities of the Company and its users regarding the use of piqe and any related services provided by the Company.

Article 2. Definitions

  • "Service" refers to the piqe platform including the website, mobile applications, and all related features such as artwork browsing, Piqe points, rankings, and communication tools.
  • "User" refers to any person who accesses or uses the Service, including members and non-members.
  • "Member" refers to a user who has completed registration and agreed to these Terms.

  • "Piqer" refers to a member who participates in the ranking system by Piqing artworks.
  • "Piqe credits" refers to the virtual credits provided daily to members for Piqing artworks within the Service.

Article 3. Posting and Amendment of Terms

The Company shall make these Terms available on the Service for users to review at any time. The Company may amend these Terms when necessary, provided that material changes are announced at least 7 days in advance (30 days for changes disadvantageous to users) via the Service. Continued use after the notice period constitutes acceptance of the amended Terms.

Article 4. Registration

Membership is established when a user agrees to these Terms, provides the required information, and the Company approves the registration. The Company may refuse or defer registration in the following cases:

  • Using false or another person's information
  • Failing to provide required information
  • Being under 14 years of age without verifiable parental consent
  • Previous termination of membership due to Terms violations
  • Technical or operational reasons requiring deferral

Article 5. Obligations of the Company

The Company shall:

  • Provide the Service continuously and stably, except during maintenance or force majeure events
  • Protect users' personal information in accordance with applicable privacy laws and our Privacy Policy
  • Establish and maintain a complaint resolution process and address legitimate user complaints promptly
  • Not distribute users' personal information to third parties without consent, except as required by law

Article 6. Obligations of Users

Users shall not engage in the following activities:

  • Registering with false information or using another's identity
  • Uploading content that infringes on intellectual property rights, is obscene, defamatory, or violates applicable laws
  • Manipulating Piqe points or rankings through automated tools, multiple accounts, or collusion
  • Disrupting the Service through hacking, reverse engineering, or unauthorized data collection
  • Impersonating the Company, its employees, or other users
  • Sending spam, unsolicited advertisements, or malicious content
  • Any other activity that violates applicable laws or these Terms

Article 7. Piqe Points and Rankings

Members receive 10 free Piqe credits daily. Each Piqe applied to an artwork costs 1 credit; cancelling a Piqe returns 1 credit. Unused credits expire at midnight in the user's local timezone and cannot be carried over, transferred, or exchanged for monetary value. Members who Piqe on 7 consecutive days receive 15 credits daily (Peak Streak bonus); this resets to 10 if the streak is broken. Rankings are calculated solely from free daily Piqe credits. The Company reserves the right to adjust credit amounts, expiration rules, and ranking calculation methods with prior notice.

Article 8. Intellectual Property

Artists retain all intellectual property rights to their uploaded artworks. By uploading content, artists grant the Company a non-exclusive, worldwide, royalty-free license to display, reproduce, and distribute the content within the Service for the purpose of operating and promoting the platform.

This license terminates when the artist removes the content from the Service, except where copies have been shared by other users or are required for legal compliance. The Service design, branding, and software are the intellectual property of the Company and may not be used without prior written consent.

Article 9. Paid Services

The Company may offer paid services (e.g., Pro subscription). Users may withdraw from a paid service within 7 days of purchase unless the service has been fully consumed. Refunds will be processed using the original payment method.

Article 10. Service Modification and Interruption

The Company may modify, suspend, or discontinue all or part of the Service for operational or technical reasons. Users will be notified in advance when reasonably possible. The Company is not liable for service interruptions caused by force majeure.

Article 11. Content Moderation and Account Restrictions

The Company may remove content or restrict accounts without prior notice if a user violates these Terms, applicable laws, or community guidelines. Affected users will be notified of the reason and may file an objection within 30 days. Repeated or severe violations may result in permanent account termination.

Article 12. Withdrawal and Termination

Members may withdraw from the Service at any time through account settings. Upon withdrawal, personal information is handled in accordance with our Privacy Policy.

Article 13. Limitation of Liability

The Company is not liable for service interruptions due to force majeure or circumstances beyond its control, nor for damages arising from user-provided content or interactions between users.

Article 14. Dispute Resolution

Disputes shall be resolved through mutual consultation. If unresolved, either party may contact the Korea Consumer Agency (www.kca.go.kr) or initiate legal proceedings in a competent Korean court. For general inquiries, contact hello@piqe.art. For artist-specific matters, contact artists@piqe.art.
